Legal analysis of the sanctions system in the visitation regime in Ecuador.

This article presents a legal-doctrinal analysis of the visitation regime in Ecuador and its sanctioning system, focusing on the principle of the best interests of the child. To achieve this, a qualitative methodological approach was used, through documentary analysis, examining the regulations of the Code on Children and Adolescents, the Constitution of the Republic of Ecuador, international human rights instruments, and doctrinal contributions. The study revealed that, although the legal system recognizes this regime as an essential right and has coercive instruments for its enforcement, its implementation is punitive in nature, and there is still a lack of tools for family support or interdisciplinary supervision. For this reason, a restorative-type sanction execution model was proposed, focused on prevention, family support, technical supervision, and effective judicial monitoring. The results show that, although the legal framework recognizes visitation rights as an essential right and provides coercive mechanisms for their enforcement, their execution remains predominantly punitive and lacks tools for family support and interdisciplinary supervision.
