Judicial precedent and the consolidation of constitutional law in Ecuador

The research analyzed the role of judicial precedent in constitutional matters, focusing on its influence on the interpretation and application of the Constitution. A mixed methodology was used, combining documentary, historical, and logical analysis to systematically break down and evaluate judicial decisions, identifying patterns and trends. The study highlighted the evolution of sources of law, from ancient customs to modern jurisprudence, and explored the classification of formal and material sources. Jurisprudence was examined as a continuous interpretive process, where judges weigh ethical principles and fundamental rights. The characteristics and structure of judicial decisions were detailed, emphasizing the importance of the "ratio decidendi" as a binding foundation and differentiating it from "obiter dicta." The study highlighted how the "ratio decidendi," although not strictly binding in Ecuador, significantly influences legal interpretation. The study concluded that judicial precedent, when properly applied, strengthens the coherence and predictability of the legal system, allowing it to adapt to new social realities without compromising legal certainty. It recommended a prudent application of precedent, allowing the law to evolve without rigidity, ensuring justice and equity.
