The Code of Private International Law and its impact on contemporary state sovereignty

The Code of Private International Law, commonly known as the Bustamante Code, has sparked ongoing debate since its adoption in 1928, particularly regarding its influence on state relations and its potential constraints on sovereignty. In an increasingly interdependent world, the enforcement of international private law transcends national boundaries, creating tensions between legal cooperation and state autonomy. This tension becomes evident in areas such as the recognition of foreign judgments, conflicts of laws, and international jurisdiction, where states must balance self-determination with multilateral obligations. A contemporary review of the Code invites reflection on its relevance and adaptability to twenty-first-century challenges, especially given the evolution of international law and regional treaties. In this context, sovereignty is no longer seen as an absolute principle but as a dynamic concept that coexists with legal integration and global interdependence, requiring a reinterpretation of the State’s role within international governance.
