Water: Rights of Nature and Ancestral Wisdom in Water Management in Paltas, Ecuador
Keywords:
Rights of nature, right to water, Paltas, ancestral knowledgeAbstract
This research focuses on the study of water as a human right, the rights of nature, and ancestral wisdom applied to water management in Paltas, Ecuador. Its objective is to analyze the link between the rights of nature, the right to water, and ancestral knowledge in water management in this territory. To develop this research, a review of the constitutionality of the rights of nature as a subject of rights is carried out from a biocentric perspective. It also examines the doctrine of sumak kawsay as a philosophical and legal foundation that links well-being and harmony with nature. It also delves into the right to water from its content and legal regulation in the country, as well as analyzes ancestral knowledge, its recognition in the Constitution, and its validity at the community level. This research is developed using a qualitative approach, through the application of methods such as legal exegesis, inductive and deductive approaches, and case studies, specifically of the "Planting Water for Life" project. The conclusion is that water management in harmony with nature is possible when regulations, ancestral knowledge within communities, and respect for natural cycles are integrated. It is demonstrated that Paltas is an example of how the rights of nature can be realized through local action and ancestral knowledge.
