Restrictions on inheritance capacity constitute a legal mechanism that prevents certain individuals from receiving inheritance due to moral, legal, or ethical reasons. These limitations aim not only to sanction unworthy conduct, such as attempts against the testator’s life or the violation of their will, but also to safeguard justice in asset distribution. In Ecuadorian law, specific grounds for incapacity to inherit are established, aligned with principles of fairness and the protection of legitimate heirs’ rights. Comparatively, other legal systems adopt similar approaches, though differing in the severity and enforcement of inheritance sanctions. Analyzing these restrictions reveals their influence on the equitable distribution of inheritance assets, emphasizing the need to balance the respect for the testator’s will with the defense of fundamental values such as dignity and good faith.
