Reconfiguring legal knowledge from non-linear paradigms: Contributions of complexity theory to legal theory

Abstract

The integration of nonlinear paradigms into legal thought has profoundly reshaped the ways in which legal knowledge is understood, produced, and applied. Emerging epistemologies, such as complexity theory, challenge the rigidity of traditional legal frameworks and foster a dynamic, interrelational vision of law—one that views legal phenomena as open, adaptive systems influenced by diverse social, cultural, and political factors. This epistemic shift urges a reevaluation of normative structures, the role of legal practitioners, and the interpretative function of law, guiding legal knowledge toward a more holistic, inclusive, and dialogical approach. Complexity is no longer seen as a threat to legal certainty, but rather as an opportunity to democratize and enrich legal practice, embracing uncertainty as an intrinsic element of contemporary legal phenomena.
