Procedural configuration of voluntary joinder of parties: a systematic analysis of its doctrinal foundations.

Voluntary litisconsortium is a procedural mechanism that allows multiple parties to jointly participate in a legal proceeding when a common factual or legal link exists. This configuration is especially relevant within the framework of Ecuador’s General Organic Code of Procedures (COGEP), which promotes a rights-based and efficient model of civil litigation. Legal doctrine has further elaborated the contours of voluntary joinder from both substantive and procedural viewpoints, offering valuable insights into its scope, limitations, and implications. This paper explores the regulation of voluntary joinder under the COGEP, emphasizing its practical role and foundational principles such as procedural economy, decisional unity, and legal certainty. The interplay between legislation and doctrine sheds light on the appropriateness of this figure in modern procedural contexts and its contribution to effective judicial protection.
