Abstract

Fulfilling alimentary obligations is an essential duty within parental responsibility, ensuring the well-being and comprehensive development of children and adolescents. Ruling 10203-2013-12861 from Ecuador’s National Court of Justice sets a significant precedent by addressing the enforceability of child support payments and the legal accountability of parents. This judgment underscores the need to strengthen enforcement mechanisms and penalties against non-compliance, safeguarding the fundamental rights of minors. Furthermore, it highlights the tension between the principle of the best interests of the child and the procedural guarantees of alimentary debtors. From this analysis, a reflection emerges on the effectiveness of public policies aimed at child protection and the role of jurisprudence in their consolidation.
