Constitutional challenges of pretrial detention: limits and tensions regarding the presumption of innocence in the Ecuadorian criminal justice system

Preventive detention, intended as an exceptional precautionary measure, has become a widespread practice that undermines the constitutional principle of the presumption of innocence in Ecuador. This legal tension reflects a profound imbalance between the need to ensure procedural attendance and the duty to safeguard the defendant’s fundamental rights. The excessive and disproportionate use of this measure not only violates procedural guarantees but also contributes to prison overcrowding and the erosion of public trust in the justice system. The absence of consistent legal standards and the use of preventive detention as anticipatory punishment expose a crisis of guarantees. Legal reform and strengthened judicial independence are essential to prevent its misuse. In this context, upholding the presumption of innocence is not only a legal imperative but also a foundational condition for a fair and democratic criminal justice system.
