Legal dimensions of human well-being: a focus on constitutional guarantees and integral development

Abstract

Human well-being has been a subject of reflection in various disciplines, yet its legal framing reveals how law can serve as an effective mechanism to promote a dignified life. Through the analysis of constitutional guarantees and international human rights instruments, it becomes evident that legal protection of well-being extends beyond access to basic services to include the promotion of conditions for integral development. Although the concept of happiness is inherently subjective, it gains legal relevance when associated with human dignity, social justice, and the full exercise of fundamental rights. Thus, legal frameworks must remain dynamic and responsive to the evolving needs of society, aiming to balance individual freedom with collective responsibility. This comprehensive vision calls for a critical reassessment of the State’s role and the legal system in shaping societal well-being.
