The protection action, administrative acts and fundamental rights, in the face of their effectiveness

The protection action, the administrative acts and the fundamental rights, compared to their effectiveness, is the title of the present investigation that proposes as a general objective: to contrast the effectiveness of the protection action and its procedural and constitutional requirements, compared to the processing administrative procedure provided to challenge administrative acts that violate fundamental rights, in accordance with the urgency and effectiveness that procedural speed merits and respects. To achieve this, a qualitative approach is adopted, through the exhaustive review of regulations, jurisprudence and doctrinal contributions, accompanied by methods such as analytical-synthetic, legal comparative, exegetical and inductive. The study reveals that, although the protection action is conceived as an immediate mechanism to safeguard fundamental rights, the subsidiarity clause and the complexity of the contentious-administrative procedure can limit its effectiveness, especially when the plaintiff faces delays or excessively formal procedures. Consequently, the adoption of uniform interpretative guidelines is suggested, harmonizing the role of the protection action with the contentious jurisdiction so that constitutional rights are not left unprotected in the face of arbitrary actions by the Administration.
